By accessing or using the Service, you acknowledge that you have read, understood, and agreed to these Terms and Conditions ("Terms"). If you do not agree to these Terms or are not eligible to use the Service, you must not use the Service.
Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and GoGlobal-eSIM and neither party has authority to bind the other.
1. Service Description
GoGlobal-eSIM provides prepaid eSIM products that enable customers to access mobile data services without the need for a physical SIM card. Services are delivered electronically and rely on third-party network operators and roaming partners.
2. Registration
By purchasing or using a GoGlobal-eSIM product, you agree to these Terms and Conditions and any policies, procedures, or operating rules published by GoGlobal-eSIM from time to time. Such policies are incorporated into these Terms by reference and may be amended periodically.
3. Privacy
We are committed to protecting your personal information through industry-standard security measures.
By using the Service, you consent to our use of information provided during registration to administer your account, provide customer support, obtain feedback, and notify you about products and services.
You may request correction or deletion of your personal information at any time. We also collect technical information relating to your use of the Service, including device information, operating systems, browser information, and IP addresses. Such information is used to troubleshoot issues, analyse usage, and improve the Service.
It is your responsibility to ensure that the personal information you provide remains accurate and up to date.
4. Intellectual Property Rights
All trademarks, logos, trade names, copyrighted materials, software, and other intellectual property associated with GoGlobal-eSIM remain the exclusive property of GoGlobal-eSIM or its licensors.
You may not copy, modify, distribute, or otherwise use any intellectual property without our prior written consent. Use of the Service does not transfer ownership of any intellectual property rights.
5. GoGlobal-eSIM Account
5.1 Activation of Service
Following purchase, your eSIM will be delivered electronically via email and made available for installation.
The contract shall automatically terminate if no active data package is associated with the eSIM for a continuous period of 180 days or if the eSIM is deleted from the device.
5.2 Fees and Payments
Payments are accepted through debit cards, credit cards, PayPal, Stripe, and Shopify Payments.
GoGlobal-eSIM does not store or process sensitive payment card information. Payment information is handled by secure third-party providers in accordance with applicable industry standards.
By purchasing GoGlobal-eSIM products, you also agree to the terms and conditions of your payment provider.
5.3 Termination
You may terminate your use of the Service at any time. Termination takes effect immediately and does not entitle you to a refund for unused portions of the Service unless required by applicable law.
GoGlobal-eSIM reserves the right to suspend or terminate the Service for legitimate business, security, or legal reasons.
6. Refunds and Use of Services
6.1 Refunds and Cancellations
6.1.1 Refund Eligibility
Refund requests may be submitted within thirty (30) days of purchase where activation remains impossible following reasonable troubleshooting efforts undertaken jointly by GoGlobal-eSIM and the customer.
6.1.2 Customer Cooperation
Customer cooperation in resolving technical issues is required before a refund can be granted.
6.1.3 Expired Data Packages
Each data package has a specified validity period. No refunds are available for unused data after expiry.
6.1.4 Additional Charges
GoGlobal-eSIM is not responsible for costs incurred through alternative devices, SIM cards, network providers, hotel telephones, or other services not directly associated with the customer's GoGlobal-eSIM account.
6.1.5 Fraudulent Activity
GoGlobal-eSIM reserves the right to refuse refunds where there is evidence of abuse, violation of these Terms, or fraudulent activity.
6.1.6 Statutory Consumer Rights
Nothing in these Terms excludes or limits rights or remedies available under applicable consumer protection laws, including the Consumer Rights Act 2015. Your statutory rights remain unaffected.
6.2 Use of Services
You are responsible for ensuring that your device is eSIM-compatible and is not carrier-locked before purchase.
If an eSIM cannot be activated, customers may request a refund or alternative package. Refunds are not available where incompatibility results from the customer's device or network restrictions.
If an eSIM remains unused for 180 days following the last purchase, GoGlobal-eSIM may deactivate the eSIM. Any remaining balance or unused data may be forfeited.
Customers must notify GoGlobal-eSIM immediately if a device is lost or stolen.
You are solely responsible for all information, communications, and content transmitted through the Service.
7. Limitation of Liability
GoGlobal-eSIM shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, revenue, data, business opportunities, or use arising from or relating to the Service.
GoGlobal-eSIM's total liability for any claim shall be limited to the amount paid by the customer for the Service during the twelve (12) months preceding the event giving rise to the claim.
GoGlobal-eSIM shall not be responsible for any interruption, loss of service, or damages resulting from a customer accidentally deleting an eSIM from their device.
8. Changes to These Terms
GoGlobal-eSIM may modify these Terms at any time. Changes become effective upon publication on the website. Continued use of the Service constitutes acceptance of the updated Terms.
9. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales.
Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
10. Third-Party Services
GoGlobal-eSIM is not responsible for third-party websites, network operators, services, or resources linked to or referenced by the Service and accepts no liability for their availability, content, or performance.
11. Waiver
Failure by GoGlobal-eSIM to enforce any provision of these Terms shall not constitute a waiver of any right or provision.
12. Force Majeure
GoGlobal-eSIM shall not be liable for delays or failures resulting from circumstances beyond its reasonable control, including natural disasters, acts of government, war, terrorism, civil unrest, labour disputes, power failures, cyberattacks, or failures of third-party providers.
13. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, GoGlobal-eSIM disclaims all express or implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
14. Service Availability and Roaming Partners
GoGlobal-eSIM relies on third-party network operators and roaming partners. Coverage, speed, and availability may vary depending on device compatibility, location, and network congestion.
GoGlobal-eSIM does not guarantee uninterrupted or error-free service. Temporary interruptions, maintenance, network limitations, and outages affecting third-party providers may occur. GoGlobal-eSIM shall not be liable for losses resulting from such interruptions.
15. Prohibited Uses
You agree not to:
i. Use the Service unlawfully;
ii. Engage in fraudulent or abusive activity;
iii. Transmit malware or malicious code;
iv. Interfere with or disrupt networks or systems;
v. Infringe the rights of others; or
vi. Use the Service in a manner that adversely affects other users.
GoGlobal-eSIM reserves the right to suspend or terminate accounts where misuse is suspected.
16. Chargebacks and Payment Disputes
If a payment is reversed, disputed, or subject to a chargeback, GoGlobal-eSIM reserves the right to suspend or terminate associated accounts and services until the matter is resolved.
Fraudulent or abusive chargebacks may result in permanent suspension and referral to relevant authorities where appropriate.
17. Sanctions Compliance
You represent and warrant that you are not located in, organised under the laws of, or ordinarily resident in a country or territory subject to sanctions or trade restrictions imposed by the United Kingdom, European Union, United States, or any other applicable authority.
You further represent that you are not listed on any applicable sanctions or restricted party list.
GoGlobal-eSIM reserves the right to refuse, suspend, or terminate the Service where required to comply with applicable sanctions, export controls, or trade restrictions.
18. Consumer Rights
Nothing in these Terms excludes or limits rights that cannot lawfully be excluded. Your statutory rights remain unaffected.
19. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
20. Entire Agreement
These Terms, together with any policies incorporated by reference, constitute the entire agreement between you and GoGlobal-eSIM regarding the Service and supersede all previous agreements or understandings.
